Free Speech – Victory for Kurt and Lisa Healy, of Felton, DE!
In December 2008, Kurt and Lisa Healy, residents of Felton, DE, placed a large pink sign on their lawn alerting motorists to a speed trap ahead. Shortly thereafter, the Healys received a letter from the Delaware Department of Transportation (“DELDOT”) notifying them that the sign was not approved and would have to be removed. The Healys consulted with us, and we advised them of their First Amendment right to display their sign on private property, and then contacted DELDOT on their behalf. DELDOT acknowledged that the Healys’ sign was legal, and informing them that it would not take any further action.
