UPDATE: HB 180 passed the House on Tuesday, June 16, 2026 and will now be delivered to the Senate for consideration.


House Bill 180 would amend the state's constitution to restore voting rights for people who have served their sentences for a felony.

Delaware is the only Northeastern state that permanently disenfranchises some returning citizens, and one of just 10 nationwide to do so for non-election-related offenses.

As of 2024, nearly 3,000 Delawareans were prohibited from voting while on felony probation. Nearly 1,400 these disenfranchised Delawareans were Black.

HB 180 remains pending before the Delaware General Assembly. As the legislative session approaches its conclusion, the bill has not yet received a final vote in the House.
