Summary


House Bill 58 bans police from targeting people based solely on actual or suspected immigration status or civil immigration violations.

It prohibits State law-enforcement from doing any of the following:

  • Stop, question, arrest, search, or detain any individual based on actual or suspected citizenship or immigration status, or actual or suspected violations of federal civil immigration law;
  • Inquire about an individual’s immigration status, citizenship, place of birth, or eligibility for a social security number; and
  • Make an arrest, detain, or prolong the detention of an individual based on civil immigration warrants or immigration detainers.

This bill is part of a larger slate of legislation is pending in the Delaware General Assembly now that would protect immigrants and ensure they have the support, security, and opportunity to thrive.

House Substitute 1 for House Bill 368 with House Amendment 1 (HS 1 for HB 368 w/ HA 1) reduces law enforcement's cooperation with immigration officials by limiting when they honor detainer requests. A detainer request is an administrative request from ICE to hold an individual beyond their scheduled release or notify ICE prior to their release.
