Statewide — Today, the ACLU of Delaware sent a letter to Attorney General Kathy Jennings and the Delaware General Assembly, warning elected officials that the draft legislation revising the State's loitering and solicitation statute remains unconstitutional. Among the numerous constitutional concerns are the bill’s violations of the Fourth and Eighth Amendments, which protect against unwarranted searches and seizures, as well as excessive fines and fees.

Attorney General Halts Enforcement of Loitering and Soliciting Statutes Following ACLU-DE Lawsuit
