Summary

In October 2020, the ACLU of Delaware and Community Legal Aid Society, Inc. reached a settlement with Governor John Carney in Delawareans for Educational Opportunity v. Carney. The agreement requires the Governor to seek legislation bringing new financial committments and structural changes to the way that Delaware serves disadvantaged students.

House Bill 86 provides increased funding for kindergarten through third grade students identified as eligible for basic special education services and will increase the unit count funding for K-3 Basic Special Education students by the 2023-2024 school year.

Our public schools litigation has ended, but the work is just beginning. These two bills are a direct result of our agreement with the state from the court challenge we brought to the state in 2018. These bills will bring legislative change to education funding in Delaware — and that's long overdue.
