Senate Substitute 1 for Senate Bill 2: Early In-Person Voting

The House introduced Senate Substitute 1 for Senate Bill 2 (SS 1 for SB 2).


In June 2024, the Delaware Supreme Court rejected an anti-democratic lawsuit attacking early in-person voting. Despite this, Delaware's early in-person voting option remains vulnerable to future challenges.

Senate Bill 2 (SB 2) will guarantee that early in-person voting is safeguarded for Delaware voters. Early in-person voting reduces Election Day wait times, improves election administration by allowing officials to address issues in advance, and increases voter participation.

If Delaware were to lose early in-person voting, it would be one of four states in the country to deprive voters of this option, joining Alabama, Mississippi, and New Hampshire.

According to October 2023 pollong, 69% of Delawareans support extending Delaware's early in-person voting period. SB 2 lays the groundwork for this expansion.
